Documentations for the removal of land from agricultural classification

It represents the operation by which a land surface is removed from the agricultural classification in view of changing the destination.

Necessary documents

The documentation for obtaining the approval for removal from agricultural classification of the lands located in the built-up area, approved by PUG (General Urban Planning) and PUZ (Regional Urban Planning), or the land located outside the built-up area supposes the following:

1 Obtaining the notification from A.N.I.F. (National Administration of Land Improvements).

The A.N.I.F notification is obtained by the owner on the basis of a file drafted by an authorized company.

The file includes:

  • Town planning certificate;
  • Land book excerpt;
  • Ownership documents;
  • Cadastral documentation;
  • Copy of the identity documents;
  • Site plan for the real estate proposed to be removed from agricultural classification;
  • Site development plan;
  • Drawing with the proposed layout of the target area on which we highlight the surfaces required to be removed from the agricultural classification.

After obtaining the notification from A.N.I.F. (National Administration of Land Improvements), the documentation is submitted to the Cadastre Office and to the Directorate for Agriculture and Rural Development in order to obtain the final decision of removal from agricultural classification.

For the land outside the built-up area the following documents are also necessary:

  • Documentation for framing the land into the quality class (to be issued by the County Office for Pedological and Agrochemical Studies);
  • Copy of the tax payment proof to the Directorate for Agriculture and Rural Development;
  • Favourable approval in principle from the local council for extending the land outside the built-up area;

If the documentation of removal from the agricultural classification is drafted in view of erecting some constructions which need the building permit, one has to pass the land removed from the agricultural classification into the built-up area classification. That is why we recommend, in order to avoid the problems, that the land is first of all passed from outside the built-up area into the built-up area and then removed from the agricultural classification, as the answer of the County Council for extending the built-up area may be negative and thus the documentation for removal is useless.
