Documents necessary for registration in the Land Book

The Land Book includes the exact evidence of the real-estates and owners and proves the existence of the true registered right to be transmitted, constituted, amended or, as the case may be, extinguished and crossed out as a result of legal acts and facts relating to a immovable asset. We can also register or cross out other legal relations, personal rights, interdictions, incapacities and legal disputes from the Land Book, in relation to the real estate. You have hereunder the documents necessary to be submitted to the Land Book in view of registering some legal rights and facts related to the real estate.

1 - Documents necessary for entry of a land into the land book:

  • Cadastral documentation;
  • Property documents of the real-estate (sale-purchase agreement, inheritances…);
  • Tax Clearance certificate for Cadastre and Entry into the Land Book from the Tax Administration;
  • Identity documents for the owner/owners;
  • Standard application filled in and signed by the owner;
  • Statement on the property limits for which the measurements are executed;
  • The application for registration in the Land Book;
  • Fee payment proof.

2 - Documents necessary for entry of a building into the land book:

  • Cadastral documentation;
  • Property documents of the real-estate (sale-purchase agreement, inheritances…);
  • Tax Clearance certificate for Cadastre and Entry into the Land Book from the Tax Administration;
  • Identity documents for the owner/owners;
  • Standard application filled in and signed by the owner;
  • Statement on the property limits for which the measurements are executed;
  • The application for registration in the Land Book;
  • Fee payment proof.

3 - Documents necessary for the issue of the land book extract for information purpose:

  • Standard application;
  • Fee payment proof.

4 - Documents necessary for the issue of the land book extract for legalization purpose:

  • Standard application drafted by the notary public, signed by the owner of the real-estate as well;
  • Fee payment proof.

To be issued only to the notary public!

5 - Documents necessary for the reformation of the land books:

  • Standard application;
  • Notarized statement from the owners, from which it should result that the legal status of the real-estate is the true one in view of reformation;
  • A previously issued land book extract with the last known situation of the property or the acquisition document;
  • Tax Clearance certificate from the local city hall;
  • Fee payment proof.

6 - Documents necessary for the issue of land book copies according to the original:

  • Standard application;
  • Fee payment proof.

7 - Documents necessary for the issue of land book copies according to the documents of the land book archive:

  • Standard application;
  • Fee payment proof.

8 - Documents necessary for registering the acts of dismemberment /apartments division / unification:

  • Standard application;
  • Cadastral documentation;
  • Dismemberment/ apartments division /unification document;
  • Fee payment proof.

9 - Documents necessary for changing /registering the administrative address in the land book:

  • Standard application;
  • Certificate from the city hall stating the correlation between the cadastral number and the administrative address;
  • Fee payment proof.

 

10 - Documents necessary for registering the lease agreements:

  • Standard application;
  • Lease agreement concluded for a period longer than 3 years, which shall include the identification of the real-estate;
  • Fee payment proof.

11 – Documents necessary for entry of the concession right:

  • Standard application;
  • Concession agreement;
  • Fee payment proof.

12 - Documents necessary for the cancellation of mortgage and interdiction of sale and encumbrance:

  • Standard application;
  • Statement of the creditor /notice from the crediting bank with its explicit agreement relating to the cancellation of the mortgage and interdiction of sale or encumbrance, with the identification of the real-estate;
  • Fee payment proof.

13 - Documents necessary for registering the disputes in the land book:

  • Standard application;
  • Copy of the action registered in the court of law specifying the case number or the certificate of the record office identifying the real-estate with the cadastral number, land book number and locality;
  • Fee payment proof.

14 - Documents necessary for registering the payment summons in the land book:

  • Standard application;
  • Summons issued by the bailiff in the enforcement file;
  • Report for the identification of the real-estate;
  • Fee payment proof.

15 - Documents necessary for amending the name of a company, merger/incorporation:

  • Standard application;
  • Addendum concluded with the observance of the forms prescribed by the law, with the registration proof at the office of the trade register or the conclusion of the delegated judge at the office of the trade register;
  • Registration certificate – certified copy;
  • Fee payment proof.

16 - Documents necessary for cancellation of the property right dismemberments (use, usufruct, habitation, easement, superficies):

  • Standard application;
  • Document certifying the cancellation – certified copy;
  • Fee payment proof.

17 - Documents necessary for registering the adjudication documents:   

  • Standard application;
  • Adjudication document which should identify the real-estate by the topographic /cadastral number and land book /locality number;
  • Tax clearance certificate with the taxation value;
  • Fee payment proof.

18 - Documents necessary for registering the legal decisions;   

  • Standard application;
  • Final and enforceable legal decision and the expert’s report which is part of the legal decision, as the case may be. When the rights of action have been exercised, you shall enclose all the legal decisions given in that case;
  • Fee payment proof.

19 - Documents necessary for registering the mortgage right:   

  • Standard application;
  • Mortgage agreement;
  • Fee payment proof.

18 - Documents necessary for registering the property right acquired by inheritance:   

  • Standard application;
  • Inheritance certificate;
  • Fee payment proof.
